Terms and Conditions of Sale

 

ARTICLE 1 – SCOPE

These General Terms and Conditions of Sale (hereinafter referred to as the “GTC”) apply without restriction or reservation to all sales concluded between Lumiere Diffuse (the “Seller”) and any non-professional buyer (the “Customer”) wishing to purchase the products offered for sale on the official website: https://www.lumierediffuse.com.

The products offered on the site primarily include clothing and fashion accessories, reflecting the brand’s core values of kindness, resilience, and positivity. The essential characteristics of each product (description, images, dimensions, etc.) are available on the product page. It is the Customer’s responsibility to consult this information before placing an order.

Some items on the website may be offered on a pre-order basis. Customers are advised to read Article 12 carefully before placing such orders. By purchasing a pre-order item, the Customer acknowledges that it is not immediately available for shipment, and that the estimated production and delivery timeframes—clearly indicated on the product page—may be subject to change.

The selection and purchase of products are the sole responsibility of the Customer. Product offers remain valid while stocks last, as indicated at the time of ordering.

These GTC are available at any time on the website and take precedence over any other contradictory documents or communications.

By confirming their online order, the Customer acknowledges having read and accepted these GTC in full, by ticking the designated checkbox prior to payment.

Unless proven otherwise, the data recorded by the Seller’s computer system shall constitute proof of all transactions with the Customer.

ARTICLE 2 – PRICE

Products are sold at the prices displayed on the website at the time the order is validated. Prices are expressed in euros (€). As the Seller operates under the French auto-entrepreneur regime, VAT is not applicable (Article 293B of the French General Tax Code), unless stated otherwise.

These prices take into account any applicable discounts or promotions displayed on the website. Prices are valid for the period indicated but may be modified at any time outside that period.

Delivery fees are fixed per zone, as indicated on the website, and will always be displayed before payment. No hidden charges will be added upon receipt of the order.

For pre-ordered products, prices remain fixed during the pre-order campaign and are clearly communicated before purchase. The Customer acknowledges that these items are not immediately available and that production and delivery will follow a longer timeline, detailed on the product page.

In the event of a price change between the time of order placement and payment processing, the Customer will be informed. If the price increases, the Customer has the right to cancel the order and request a full refund.

An invoice will be issued and sent to the Customer upon shipment or delivery of the order.

 

 

ARTICLE 3 – ORDERS

The Customer places their order online by following these steps:

1. Product Selection: The Customer selects the desired product(s) (size, color, quantity) and adds them to the shopping cart.

2. Cart Verification: By clicking on the cart icon, the Customer can view, modify, or validate their selection before proceeding.

3. Delivery: The Customer provides a delivery address and selects the shipping option (Pickup Point or Home Delivery, depending on the zone, as specified in Article 5).

4. Payment: The Customer chooses a secure payment method (credit card, PayPal, etc.) and validates the payment information.

5. Order Confirmation: After reviewing the order summary, the Customer confirms the order by clicking the confirmation button.

6. Acknowledgment: A confirmation email is sent with a detailed summary of the order and, if applicable, a tracking number.

7. Debit & Preparation: The payment is processed immediately. The order is then prepared and dispatched, and a shipping confirmation email is sent.

Pre-order items: Production starts after the pre-order period ends. Delivery timelines are indicated on the product page. Pre-ordered items may be shipped separately if combined with in-stock products, unless otherwise specified.

The sale is considered final once full payment has been received. The Customer is solely responsible for the accuracy of the information provided during the ordering process.

If the information is incorrect or incomplete, the Seller reserves the right to delay or cancel the order.

 

ARTICLE 4 – PAYMENT

All payments are made in euros, unless otherwise stated. If the Customer is located outside the euro zone, their payment will be converted into their local currency at the exchange rate in effect at the time of the transaction. Any bank and currency conversion fees are the responsibility of the Customer.

Payment methods accepted include credit card (Visa, MasterCard, American Express), bank transfer, PayPal, and secure payment options such as Apple Pay or Google Pay. Payment is due in full and immediately upon placing the order. Installment payments are not accepted.

Orders will not be confirmed until full payment is received. In case of payment refusal or transaction error, the order will be canceled.

For preorder items, production typically begins within 14 days after the preorder period ends. The Customer will be notified by email before production starts.

In accordance with applicable European Union consumer protection laws, the Customer has the right to withdraw from the purchase within 14 days of receiving the goods, including for pre-order items, provided they are not custom-made or personalized.

The Seller reserves the right to suspend or cancel the order in case of non-payment or incomplete payment.

 

 

ARTICLE 5 – DELIVERY

All products from Lumiere Diffuse are made to order, including preorder items. The standard processing time is 1–3 business days before shipping.

Delivery is currently available only within the European Union (EU).

• France (Zone 1): 3–5 working days  

   Free shipping

• Nearby EU countries (Zone 2): 4–7 working days  

   e.g., Belgium, Germany, Italy, Luxembourg, Netherlands, Portugal, Spain 

   Pickup Point: €10 | Home Delivery: €13

• Other EU countries (Zone 3): 5–8 working days  

   e.g.,   Austria, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, Greece, Hungary, Ireland, Latvia, Lithuania, Malta, Poland, Romania, Slovakia, Slovenia, Sweden  

   Pickup Point: €15 | Home Delivery: €18

These estimated delivery timelines may vary due to customs clearance (if applicable), holiday periods, unforeseen production delays (especially for preorders), or other circumstances beyond our control.

Delivery is carried out via trusted third-party carriers, including Mondial Relay, Boxtal, Colissimo, and similar networks.

Customers are required to inspect their order within 14 days of delivery. Any issues (such as damage or incorrect items) must be reported within this period to: bewithus@lumierediffuse.com

In accordance with European consumer protection law, customers have the right to withdraw from their purchase within 14 days of receiving the goods, without giving any reason.  
This right does not apply to products that are personalized or made to order, as they are created specifically for the customer.

ARTICLE 6 – TRANSFER OF OWNERSHIP

Ownership of the Products will only transfer after full payment of the price by the Customer, regardless of the delivery date or the physical receipt of the Products.

For pre-order items, ownership is also transferred upon full payment, even if the product is still in production or has not yet been shipped.

However, this does not affect the Customer’s statutory right of withdrawal under applicable EU consumer law, where applicable.

 

 

ARTICLE 7 – RIGHT OF WITHDRAWAL

The Customer has a period of 14 days from the receipt of the Products to exercise their right of withdrawal without providing any justification.

To do so, the Customer must contact customer service at bewithus@lumierediffuse.com, clearly stating their intention to withdraw.

The Products must be returned in a condition allowing resale: unworn, unwashed, and with all accessories and instructions included. The original packaging should be kept whenever possible. Items that are heavily used, damaged, or incomplete may be refused.

Return shipping costs are the responsibility of the Customer, except when the product was delivered incorrectly or is defective. Refunds will be issued within 10 working days after the returned product has been received and inspected, using the same payment method as the original purchase.

This right of withdrawal applies only after receiving the goods, in accordance with EU law.

For pre-order items, the Customer may cancel the order at any time before shipment and will receive a full refund. After receiving the product, the Customer retains the statutory right of withdrawal for 14 days, as per EU consumer protection law.

Refunds will be processed within 10 working days after the returned products have been received and inspected.

 

ARTICLE 8 – SELLER’S LIABILITY – WARRANTIES

The Products sold benefit from the following legal warranties under applicable law:

• Legal conformity warranty: This warranty applies if the Product is defective or does not conform to the order.

• Legal warranty against hidden defects: This warranty applies if the Product contains hidden defects that significantly impair its intended use.

If the Customer detects a defect, they must notify the Seller in writing within a reasonable time from the discovery of the defect. The Seller will then offer, at its discretion, a refund, replacement, or repair within 30 days following the notification.

In case of a defective or incorrect Product, the return shipping costs will be reimbursed upon presentation of proof of payment (e.g., receipts).

The Seller’s liability shall not be engaged in cases of misuse, negligence, improper handling, or force majeure events.

Pre-order Products also benefit from the same legal warranties. However, due to their made-to-order nature, the Seller may offer a refund instead of a replacement, depending on the feasibility of production.

 

 

ARTICLE 9 – PERSONAL DATA

The Customer is informed that their personal data is collected for the purpose of fulfilling the sales contract, managing deliveries, and for marketing communication purposes (with prior consent). These data include the name, email address, postal address, phone number, payment information, and purchase history.

Personal data collected during preorder phases is subject to the same conditions and protections as those collected during standard sales. This data will be used for order processing, payment confirmation, and delivery tracking related to preorder products.

Personal data will never be shared, transferred, or sold to third parties for commercial purposes, unless necessary for the execution of the order, such as with payment service providers, carriers, or other partners essential for the delivery of Products. Any other use of the data will require the Customer’s explicit consent.

The processing of personal data complies with Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR) and the French Data Protection Act.

The Customer has the right to access, modify, delete, and transfer their data, as well as the right to withdraw their consent for marketing purposes. To exercise these rights, the Customer can contact the Seller via email or postal mail. The Seller will respond within one month.

In case of refusal, the Customer may lodge a complaint with the CNIL (Commission Nationale de l’Informatique et des Libertés) or another competent supervisory authority.

 

 

ARTICLE 10 – INTELLECTUAL PROPERTY

The content of the website https://www.lumierediffuse.com/ is protected by intellectual property laws. Any total or partial reproduction is prohibited without prior authorization from the Seller. In case of infringement, the Seller may take legal action. Preorder materials and exclusive designs are also protected under intellectual property laws.

 

 

ARTICLE 11 – DISPUTES

In case of a dispute, we invite the Customer to contact us directly to attempt to resolve the issue amicably. The Customer can reach us via email or our social media platforms.

If no solution is reached after this internal mediation step, the Customer may resort to the European Online Dispute Resolution (ODR) platform:

This dispute resolution procedure applies to all orders, including preorders.

These GTC are governed by French law. In the event of litigation, the competent courts of Lyon, France, shall have jurisdiction.

 

 

ARTICLE 12 – PRE-ORDERS

Some Products on the website may be offered on a pre-order basis, meaning they are not yet manufactured or available for immediate shipment at the time of purchase.

By placing a pre-order, the Customer acknowledges and agrees to the following terms:

  • Estimated Delivery: Each pre-order product page clearly states the estimated production and delivery timeframes. These are indicative and may be subject to slight changes due to production or logistics constraints. For details, see Article 5 – Delivery.

  • Full Payment: Pre-orders must be paid in full at the time of purchase.

  • Right of Withdrawal: The Customer retains their legal right of withdrawal within 14 days of receiving the Product, in accordance with European Union consumer protection law.

  • Delays: In the event of significant delays (e.g., exceeding 30 days beyond the estimated delivery window), the Customer will be notified by email. Before shipment, the Customer may request cancellation and a full refund.

  • Non-Immediate Availability: Pre-order Products are custom-made or produced in small batches and may not be restocked. By placing a pre-order, the Customer secures access to a limited production run.

  • Cancellation: Pre-orders can be canceled at any time, regardless of the production stage. The Customer will receive a full refund for canceled pre-orders.

  • Refunds: Refunds for canceled pre-orders or returns will be processed within 10 working days after receipt and inspection of the returned Products, using the same payment method as the purchase. Except in cases where the product is defective or incorrect, the Customer shall bear the return shipping costs.
